Sheds2fencing LTD – Terms and Conditions of Sale

1. Definition of Words Used Within This Document “Buyer” – The person or company who buys Goods from the Seller. “Consumer” – The meaning attributed in the Unfair Contract Terms Act 1977, section 12. “Goods” – The products that the Buyer agrees to buy from the Seller. “Services” – Any installation, erection, or fitting work agreed to be carried out by the Seller. “List Price” – The list of prices of the Goods maintained by the Seller as revised from time to time. “Seller” – Sheds2fencing LTD. “Terms and Conditions” – The terms and conditions of sale set out in this document and any other special terms and conditions agreed in writing by the Seller.

2. General These Terms and Conditions apply to all contracts for the sale of Goods by the Seller to the Buyer and will prevail over any other documentation or correspondence from the Buyer. Any variation to these Terms and Conditions will be irrelevant unless agreed in writing by the Seller. Orders placed will be regarded as an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may decide not to accept an order for any reason. Acceptance of delivery of the Goods will be regarded as conclusive evidence of the Buyer’s acceptance of these Terms and Conditions. Product pictures on the website are for illustrative purposes only; colours and styles may vary. Sizes are approximate and may differ slightly. The Buyer must determine and agree on the specification, design, and construction of the product and accept responsibility that it is adequate and suitable for the intended purpose.

3. Cost and Payment The cost of the Goods will be that specified in the Seller’s current List Price, on the Seller’s website, or as contained in the Seller’s quotation at the date of the order or as agreed between the parties. The cost is inclusive of VAT and excludes any delivery charge. In the event of any pricing errors, we cannot be held responsible. Any errors will be rectified as soon as possible. If an error is discovered after order placement, we will inform you as soon as possible. We will not be obliged to fulfil an order for incorrectly priced products. If the item has been charged, you will receive a full refund or be liable for the difference. The price quoted for concrete bases can vary depending on access / complexity. Full payment of the total purchase price, including VAT and delivery charge, must be made at the time of ordering unless agreed otherwise in writing by the Seller. Deposits for sheds are non-refundable under any circumstance.

4. Warranty The Seller warrants that the Goods will correspond to the description given by the Seller at the time of delivery. Should it be necessary to offer an alternative product, this will be agreed upon with the Buyer before dispatch. Warranty claims regarding shed felt are limited. Shed felt is a temporary roof covering, and its longevity can be affected by location and weather. We recommend upgrading to a more durable roofing solution for long-term protection.

5. Delivery Delivery of the Goods shall be made by the Seller informing the Buyer that the Goods are available for collection or for delivery to the place on such terms as agreed at the time of order placement. Local orders will generally be delivered within 1–5 working days where possible and if goods are available. Delivery can be requested up to 28 days from the order date. All deliveries are to be completed within 28 days of ordering. Deliveries are kerbside only, and the goods will be stacked as neatly as possible. The Goods may be taken onto your property at the driver’s discretion, and Sheds2fencing LTD takes no responsibility for damages to driveways, pathways, or landscaping caused during the delivery process. Risk in the Goods passes to the Buyer upon delivery. However, Title (ownership) of the Goods shall not pass to the Buyer until the Seller has received payment in full regarding all sums due. The Buyer will be responsible for the disposal of any pallets used for delivery.

6. Cancellation & Returns Orders, apart from custom-sized/made products, can be cancelled. If you need to cancel your order, we require at least 24 hours’ notice before your scheduled delivery. If cancellation occurs within 24 hours of delivery, a 10% fee will apply. Goods that are surplus, unsuitable, or ordered incorrectly may be returned by the Buyer within 14 days of collection/delivery at their own cost. A refund, minus a 20% restocking charge and a £3.00 administrative fee, will apply if goods are returned in a saleable condition with all packaging and components intact. If not, the refund amount may be reduced accordingly. Under the Consumer Protection (Distance Selling) Regulations, you have the right to cancel your order within 7 days of receipt. However, return costs are the responsibility of the Buyer. If Goods are found damaged upon return due to the Buyer’s fault, the Buyer will be liable for the cost of remedying such damage. All refunds are subject to a flat £3.00 administrative fee.

7. Damaged and Faulty Goods Sheds2fencing LTD aims to provide high-quality products and service. However, the Buyer should be aware of the following points regarding timber and concrete:

  • Timber is a natural material and may vary in shades and alter further with weathering.

  • Shrinking and expansion of timber may occur due to seasonal changes.

  • Splits and cracks (shakes) in timber posts and panels are natural occurrences as wood dries and do not affect the structural integrity of the product. These are not considered faults.

  • Knots in timber are natural and may dislodge over time.

  • Surface green spotting from the pressure treatment process will fade over time.

  • Concrete products may exhibit small hairline cracks or air holes; these are not considered structural defects. Concrete may also exhibit “efflorescence” (a white powdery residue), which is a natural chemical reaction and will fade over time.

The Buyer must inspect Goods upon receipt. Once signed for, they are deemed acceptable. Any issues must be reported within 24 hours of delivery via email to info@sheds2fencing.co.uk or by phone at 01603 514199. Claims for defective or damaged Goods must be supported by photographic proof. It is at Sheds2fencing LTD’s discretion whether the issue warrants a full replacement or replacement parts. Replacement parts are to be fitted by the Buyer. If necessary, the Seller will collect large faulty items; otherwise, the Buyer must return the item for a replacement or full credit (excluding delivery costs). The Seller will not accept liability for altered Goods that subsequently prove defective.

8. Installation and Erection Services Where the Buyer has ordered installation or erection services:

  1. Ground Conditions: Quotations for fencing erection or base installation are based on “standard ground conditions” (soft, diggable soil). If the ground is found to be unsuitable (e.g., concrete, tree roots, rock, or rubble below the surface) necessitating extra labour or machinery, the Seller reserves the right to apply additional charges.

  2. Underground Services: The Buyer is solely responsible for identifying and marking the location of all underground cables, pipes, and services (gas, electric, water, drainage, fibre optics). Sheds2fencing LTD accepts no liability for damage to underground services that were not clearly marked by the Buyer prior to the commencement of work.

  3. Site Clearance: Unless agreed otherwise in the quote, the fence line or shed base area must be clear of vegetation and obstructions. If the team must clear the site, additional charges will apply.

  4. Shed Bases: If Sheds2fencing LTD is installing a shed on a base prepared by the Buyer, that base must be firm and level. If the base is unlevel, we may be unable to erect the building, and an abortive call-out charge may apply. If we must shim/pack the building to make it fit, warranties on the structure may be voided.

  5. Access: The Buyer must ensure there is clear access to the site and access to electricity/water if required.

9. Force Majeure Neither the Seller nor the Buyer will be liable for any failure or delay in fulfilling obligations due to events beyond reasonable control, including but not limited to acts of God, strikes, war, fire, machinery breakdown, adverse weather prohibiting safe installation, or material shortages.
